Cork Hillwalkers club membership agreement and disclaimer in taking membership, (as well as attending as a guest of Cork Hillwalkers) and/or attending any and all events, hikes or any activity organised by cork hillwalkers, you do so on the basis of the entirety of the following statement applying to you .
I fully accept that Cork Hillwalkers is a non-profit, voluntary-run club composed of individuals who have come together for the shared enjoyment of hiking and associated events. I fully accept and expressly agree that I participate in all club activities on the understanding that I hold no onus of responsibility in any way towards the volunteers or organisers who facilitate these activities. By taking out this membership, I acknowledge that I am responsible for my own safety and actions while participating in any Cork Hillwalkers Club activity. I understand that hiking is an inherently risky activity, often conducted in remote and challenging environments, and I expressly assume all risks associated with hiking, including but not limited to, risks arising from weather conditions, challenging terrain, wildlife encounters, and the physical demands of the activity. I acknowledge that these risks may result in serious injury or even death, and I accept full responsibility for my participation. I understand that the Cork Hillwalkers Club, its officers, leaders, or any person acting in an official capacity, do so on a purely voluntary basis. I hereby agree that no duty of care or responsibility of any kind shall rest with any of these persons or the Club itself towards me. I fully waive, release, and discharge the Cork Hillwalkers Club, its officers, organisers, leaders, and members from any and all liability, including but not limited to liability arising from negligence or breach of statutory duty, for any injury, damage, loss, or harm I may suffer as a result of my participation in any club activity. I agree to adhere strictly to the rules of the Cork Hillwalkers Club at all times, and I understand that these rules may be updated periodically. I commit to regularly reviewing these rules on the Club's official website to ensure my continued compliance. I acknowledge that my participation in any club activity is solely at the discretion of the event organiser or hike leader, whose decisions regarding my ability to participate are final and require no further justification. I recognise that the hike leader or organiser has no obligation to me whatsoever, and that any decision regarding my participation is made solely in the interest of safety and the proper conduct of the event. I fully understand and agree that the Cork Hillwalkers Club is not responsible for assessing my health, fitness, or suitability for participation in any event. It is my responsibility to consult with my General Practitioner (G.P.) or relevant qualified medical professional regarding any health, age-appropriate, or physical ability concerns before engaging in any club activities. I agree not to participate in any event if there is any doubt regarding my ability to do so safely. Participation in any event implies that I have taken all necessary medical advice, and I cannot hold the Club liable for any health-related issues that may arise during or after the event. I also understand that while the Cork Hillwalkers Club advocates for high standards of safety and compliance, no officer, organiser, or event leader is claiming to hold any professional qualifications. I accept that they act in good faith to the best of their abilities as volunteers, without the expectation of providing professional-level guidance or expertise. I also accept that I may appear in club photos, videos, and promotional materials, and I give my consent for such usage. I acknowledge that proper hiking boots are required for all hikes, and I agree to comply with this rule. I accept that failure to adhere to this rule may result in my exclusion from the activity. I understand that the Club has no obligation to provide or arrange transportation for me to any club event. Furthermore, I acknowledge that participation in weekend and holiday events requires active membership, defined as regular participation in club hikes. If I reserve a place on an overnight event without meeting the active membership criteria, I accept that any financial or other losses incurred will be entirely my responsibility. The Cork Hillwalkers Club does not accept the membership or participation of children. All members must be 25 years or older to join and participate in club activities. I accept that once I book and pay for any event organised by the Cork Hillwalkers Club, the payment is non-refundable and non-transferable. I acknowledge that the Club typically block books events on a group basis, rather than on an individual fee basis. As such, I understand and agree that no refunds or transfers will be issued if I am unable to attend the event, regardless of the reason. I understand that the Cork Hillwalkers Club does not offer any insurance for events, including but not limited to, insurance for hiking accidents, event cancellations, or losses. The Club strongly encourages all members to take out their own insurance to cover potential risks associated with hiking or other event-related losses. However, I acknowledge that the decision to obtain such insurance is entirely my responsibility. I agree that I will not hold the Cork Hillwalkers Club liable in any way for any losses, injuries, or my inability to attend any event that I have paid for. As a member of the Cork Hillwalkers Club, I agree that I will not pursue any legal action against any other member, the club’s officers, or any person acting in an official capacity for the club. I acknowledge that before taking out membership, I had the opportunity to avail of independent legal advice, and I enter into this agreement on that basis. I agree to indemnify and hold harmless the Cork Hillwalkers Club, its officers, organisers, leaders, and members from any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities, including solicitors and legal fees, arising out of my involvement in the club’s activities, and to reimburse them for any such expenses incurred. The Cork Hillwalkers Club shall not be held liable or responsible for any failure to perform, or delay in performance of, any of its obligations under this agreement that is caused by events outside its reasonable control ("Force Majeure"), including but not limited to natural disasters, weather event, pandemic, or other unforeseen events. Dispute Resolution In the event of any dispute arising out of or in connection with this agreement or my participation in Cork Hillwalkers Club activities, I agree to first attempt to resolve the dispute through good faith negotiation within the club. If the dispute cannot be resolved through negotiation, I voluntarily agree to submit to mediation as the preferred method of dispute resolution and pay my own fees for my participation. Governing Law This agreement shall be governed by and construed in accordance with the laws of Ireland Severability If any provision of this agreement is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, so that the remainder of this agreement shall otherwise remain in full force and effect and enforceable. Acknowledgement and Agreement By taking out this membership, I confirm that I have carefully read, fully understand, and agree to abide by all the Cork Hillwalkers Club rules, as well as this agreement and disclaimer. I acknowledge that I have taken the time necessary to review these rules, this agreement, and the disclaimer in detail, and have sought any needed clarification through email or other official channels before finalising my membership. I understand that it is my responsibility to ensure that I am fully informed of the club’s rules, this agreement, and disclaimer, and that I have no outstanding questions or concerns regarding them.
